The FDA ruling on RU486, the "abortion pill," is unconstitutional on two grounds.
First of all the Constitution clearly states that no person may be deprived of life without due process of law. Regardless of whether you kill a person with the slice and dice procedure, a saline solution or a pill taken in the convenience of your home or your doctors office, it is still in violation of that principle. Abortion violates the federal Constitution.
Secondly, regulatory agencies have no constitutional authority to legislate. The first sentence of the Constitution after the Preamble says "all legislative powers herein granted shall be vested in a Congress of the United States..." Congress has been derelict in failing to enforce that provision.
George Bush has said that he opposes the FDA ruling. If he is serious, he should get on the phone to Dennis Hastert and Trent Lott and tell them to have Congress rescind the ruling by the FDA - over rule it and return it to its rightful limits. What good is it to have a Republican Congress if the Republican Congress won't do what the Republican Party platform says it intends to do?
